1. Acceptance of Terms

By accessing or using Agentlyft ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all users, visitors, and others who access or use the Service, including business owners who integrate Agentlyft with their WhatsApp Business accounts.

2. Description of Service

Agentlyft is an AI-powered customer support automation platform that integrates with the official Meta WhatsApp Business Platform API. The Service allows business owners to upload knowledge base documents (such as FAQs, menus, product catalogs) and automatically respond to customer-initiated WhatsApp messages using AI-generated responses based on the uploaded content.

Agentlyft operates as a multi-tenant software-as-a-service (SaaS) platform where each business operates within an isolated tenant environment.

3. Permitted Use

The Service is intended for the following legitimate business purposes:

  • Responding to customer-initiated inquiries via WhatsApp
  • Providing customer support, product information, and business details
  • Answering frequently asked questions using uploaded knowledge base documents
  • Managing customer conversations within WhatsApp Business Platform guidelines

4. Prohibited Use

You agree NOT to use Agentlyft for any of the following activities. Violation of these prohibitions may result in immediate termination of your account:

  • Bulk messaging — sending unsolicited messages to large numbers of recipients
  • Spam — sending repeated, unwanted, or irrelevant messages
  • Unsolicited marketing — initiating promotional messages to users who have not contacted you first
  • Political messaging — using the platform for political campaigns, propaganda, or voter manipulation
  • Adult content — distributing sexually explicit, pornographic, or adult-only material
  • Misleading content — sharing false, deceptive, or fraudulent information
  • Harassment or hate speech — targeting individuals or groups with abusive, threatening, or discriminatory content
  • Illegal activities — using the Service to facilitate any activity that violates applicable laws or regulations
  • Data harvesting — collecting personal information from WhatsApp users without proper consent
  • Impersonation — misrepresenting your identity or the nature of your business

All use must comply with WhatsApp's Business Policy and Commerce Policy at all times.

5. Data and Privacy

Your use of Agentlyft is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

You are responsible for ensuring that your use of the Service complies with all applicable data protection and privacy laws, including but not limited to GDPR, CCPA, and local privacy regulations.

6. Message Content Policy

All messages sent through Agentlyft must comply with the WhatsApp Business Policy and Commerce Policy. You are solely responsible for the content of the knowledge base documents you upload and the AI-generated responses derived from them. You must ensure that:

  • All uploaded content is accurate and not misleading
  • You have the right to use and distribute the content you upload
  • AI-generated responses are appropriate for your customer base
  • Your system prompt does not instruct the AI to produce harmful, misleading, or policy-violating content

7. Account Termination

Agentlyft reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Violation of WhatsApp Business Policy or Commerce Policy
  • Fraudulent, abusive, or illegal activity
  • Non-payment of applicable fees
  • Exceeding usage limits without upgrading your plan

Upon termination, your access to the Service will be immediately revoked. We may retain certain data as required by law or for legitimate business purposes.

8. Limitation of Liability

Agentlyft is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. In no event shall Agentlyft, its officers, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to Agentlyft in the twelve (12) months preceding the claim.

9. WhatsApp Policy Compliance

Users must comply with Meta's WhatsApp Business Policy (https://www.whatsapp.com/legal/business-policy/) and Commerce Policy. Agentlyft reserves the right to terminate accounts that violate these policies without prior notice.
